generation pedigree and health record ,to date, to the Buyer at the time of transfer of said puppy. Health records of the dam and sire will be provided to the Buyer upon request. Upon proof of spay/neutering, the Breeder will register the puppy with MASCA and or NAMASCUSA provide the certificate to the Buyer. Failure to provide proof of altering by ten months of age will result in the forfeiture of all health guarantees and the Buyer must return the puppy to the Breeder at the Buyer's expense. If the puppy is returned to the Breeder due to lack of proof of altering ,the Buyer will forfeit the total cost paid to the Breeder. This puppy is sold as Pet Quality and must be spayed or Neutered by the age of eight months. There is a limited refundable $200.00 deposit for all puppies. The puppy is guaranteed to be in good health and free of known contagious diseases upon leaving our home. If within 72 hours the puppy is found not to be in good health, the Breeder agrees to A: refund the full purchase price of the dog as long as a letter from an examining veterinarian is provided to the Breeder and the puppy is returned within seven days at the Buyers expense after leaving the Breeders home. B: Keep said puppy, the breeder assumes all costs for its care provided it is determined the puppy contracted the illness at the Breeders residence. This provision expires within 72 hours after the buyer takes possession of the puppy. 2. The Breeder guarantees this dog to be free of genetic defects, including eye disease, hip dysplasia, and heart disease until the age of 24 months. Breeder will replace or offer a partial refund not to exceed one half of the purchase price with the written and signed statement from two (2) veterinarians from different clinics certifying that the said puppy/dog is suffering from one of the following: Failure to receive a passing rating on hips from the Orthopedic Foundation for Animals (OFA), failure to receive a normal reading from the Canine Eye Registration Foundation (CERF). Additional debilitating conditions due to genetic health problems must be discovered no later than 24 months. The Breeder has the right to , at any time , to decide to stop breeding. In this case a replacement puppy cannot be given then a partial refund from the purchase of said puppy will be awarded to the Buyer. The Breeder makes no guarantees regarding the loss of the puppy due to accidental death, theft, sickness due to lack of vaccinations, etc. 3. The Breeder will have the first right of refusal if the Buyer, for any reason, decides they are unable to keep the puppy up to the age of one year. The Buyer will return the dog to the Breeder at their expense or : The Breeder will assist the Buyer in placing the puppy in an approved home. The Buyer will forfeit all refunds if the return of the puppy has resulted from a management problem or any other situation that is not health related. 4. The Buyer Agrees: Buyer certifies, by signing this agreement, that said puppy will live with the Buyer and this puppy will be given proper shelter and housed securely. Puppy will be provided a secure yard , proper nutrition and exercise. Puppy food will be fed only till puppy reaches the age of 4 months. Health care will be provided from a licensed veterinarian. Buyer also certifies, by signing this agreement that he/she is not acting as an agent in this purchase; that the Buyer will not resell this puppy to a puppy mill, commercial breeder, pet store. The Buyer agrees to perform an MDR-1 on the dog when the dog reaches 10 weeks of age and to provide the results to the Breeder. The Buyer agrees to perform an OFA and CERF exam when the dog reaches 24 months and will provide the results to the Breeder. The Buyer has read and understands the foregoing and agrees that all parts of this contract constitute a binding agreement with the Breeder. If either the Breeder or Buyer takes legal action regarding this contract, action will be initiated in the county of the Breeders residence and any and all legal fees or court costs shall be the responsibility of the party found to be at fault. STUD CONTRACT : This is to certify that the bitch,__________________Reg#_______ Owned by: Was bred to the stud dog,______________________ Reg#______ On __________ for a fee of $___________/or the following in lieu of a stud fee: The following terms and conditions are understood and agreed to by both parties: (1) Prior to breeding, the owner of the bitch must provide copies of a recent CERF,MDR-1, OFA, Registration papers, a copy of the bitch’s pedigree, a record of vaccinations, proof of worming within six months and a negative Brucellosis if the bitch is a virgin this condition is void. The stud owner shall deliver a copy of the same health certificates upon receipt of either, payment in full of stud gee or possession of a puppy from the litter w/health cert. (2) Payment of the stud fee is due at the time of the first service unless other wise specified in the initial arrangement for the breeding. (3) If there is a tie, or a breeding is otherwise consummated, (AI) there will be no refund of the stud fee in whole or part. Stud owner guarantees only a mating, tie or AI and makes no guarantee as to the pregnancy of said bitch. Stud owner makes no representation as to quality of litter produced and the bitch owner agrees to make no claims against stud owner for the same. (4) If the bitch fails to whelp, the owner of the bitch must notify the stud dog owner of this fact within 10 days of the whelping date. A return service will be given by the same stud dog at the next heat unless otherwise agreed upon by the stud owner. Lack of notification as indicated above will forfeit any return service. A free service will be given if the stud dog owner is notified within 90 days of return service. Unless notice is given the return service is cancelled. (5) If the stud dog should die or otherwise become incapacitated for breeding purpose before the return service is given a refund will be given. (6) If the bitch changes ownership, any return service will be at the option of the stud dog owner. In certain cases, a substitute bitch may be accepted for the return service at the option of the stud owner. (7) If the bitch dies or aborts before whelping, the stud owner must be notified immediately if there is to be consideration given for a return service. (8) Live birth of two or more puppies living up to three weeks of age will be considered a litter. (9) It is understood that the stud dog owner shall maintain reasonable care of the bitch while at the stud dogs owners facility or under the care of the stud dogs owner agent. The stud dog owner or agent shall not be held responsible for any loss, injury or death of the bitch while under their supervision or while in transit by a private or commercial carrier. (10) Any bitch that cannot be bred due to viciousness, fear or any other extreme behavior problem will be immediately returned to the owner at the bitch owners expense. It is the bitch owners responsibility to disclose any habits that might endanger the bitch or stud dog. (11) In addition to the stud fee, it is understood that the owner of the bitch will assume all costs incurred by the stud dog owner for any medical treatment by a veterinarian required for the bitch while under the supervision of the stud dog owner or their agent. This includes all adjunct charges for AI. (12) All semen will be inseminated into one bitch resulting in one litter. Only one litter registration will be signed by stud owner.
